I understand that MTY Franchising Inc. and its affiliate (in cases where MTY’s affiliate acts as the franchisor) (collectively “MTY”) will collect, store and use personal information of mine to review and evaluate my application to obtain a franchise for the brand(s) listed on Section1 on Page 1 of this application and that I will fill out a franchise application and remit it to MTY. If my application is to obtain a New Franchise, I understand that the evaluation of my application may include a credit and asset verification, a criminal record and background check, a verification of my current financial situation, of my education and of my previous work and employment history. If my application is for an extension of an existing franchise, I understand that the evaluation of my application may include a credit and asset verification, a criminal record and background check and a verification of my current financial situation. As part of the evaluation process, I acknowledge that MTY may contact third parties and communicate to third parties (such as credit agencies and financial institutions) certain personal information in order to obtain additional personal information of mine and it may hire third party service providers (such as C- Squared) to do so.
In the event my franchise application to obtain a New Franchise is not retained by MTY, all records of my personal information collected by MTY is to be destroyed.
Should my application to obtain a New Franchise be retained by MTY or if my request to extend my Existing Franchise is accepted, I acknowledge that MTY will store and use the personal information of mine that MTY collected for the purposes of training and onboarding into the franchise system
(when required), of preparing contracts and notices related to the franchise, of processing payments, of collecting monies that may be owed in connection with the franchise, of verifying my credit worthiness and for the purpose of record keeping when such record keeping is required by law. I acknowledge that the personal information collected will be kept and used by MTY for the duration of my business relationship with MTY and it will made available to MTY’s operation, franchising, real estate, legal and accounting teams. I acknowledge that some of the personnel within the foregoing MTY teams work outside of the province in which I reside. I acknowledge that, from time to time, MTY may ask me to update the personal information of mine that it holds and that I may be required to complete a franchise application at the time of any extension of my New Franchise or Existing Franchise, as applicable. I acknowledge that MTY may disclose my name, address and phone number to prospective franchisees of the same brand as my New Franchise or Existing Franchise, as applicable, as required by franchise disclosure legislation for up to two years following the end of my business relationship with MTY.
I understand that MTY will grant me access to personal information of mine that it collected and the opportunity to correct any inaccurate personal information, as provided by law. I understand that I may withdraw my consent to the communication or use of the personal information collected by MTY, subject to any legal requirements. I am aware that MTY’s Privacy Policy can be consulted at https://mtygroup.com/privacy-policy.
