Position Title: MAGISTRATE (4040-44)

ESSENTIAL DUTIES AND RESPONSIBILITIES

Manage an assigned docket including setting and conducting hearings on motions, temporary orders, pre-trials, trials and post-judgment motions pursuant to Rule 53, Ohio Rules of Civil Procedure.

Issue orders regarding discovery, case scheduling and related pre-trial matters.

Issue temporary orders on parenting time, custody and support pursuant to 75(N) Ohio Rules of Civil Procedure.

Issue timely written decisions supported by findings of facts and conclusions of law regarding valuation and division of marital property and all other matters including permanent custody.

Adjudicate petitions for domestic violence and dating violence civil protection orders pursuant to R.C. 3113.31. Conduct full hearings to adjudicate petitioners.

Adjudicate Motions to Modify DV/CPOs and Motions to Terminate DV/CPOs.

Review Agreed Entries and Shared Parenting Plans for court approval or rejection for corrections. Review and prepare decrees as necessary to support the Court’s mission to timely administer justice. Substitute for judges when requested to hear and render decision for uncontested Complaints for Divorce. Conduct final merit hearings. Research law to substantiate decisions and remain current regarding changes in statutory and case law. Utilize alternative technology for court hearings. Assist other court personnel in the development of court rules and forms and procedures related to their specific area of responsibility. Participate in programs to educate the public and litigants regarding court procedures and the court experience

MINIMUM QUALIFICATIONS

Must possess a J.D. or L.L.M. Must be admitted to practice law in the State of Ohio and in good standing at time of application for position. Minimum of four years in the practice of family law issues or equivalent experience.

LICENSURE OR CERTIFICATION REQUIREMENTS

40 Credit hours of continuing education every two years, 10 of these hours must be Judicial College Credits

KNOWLEDGE, ABILITIES AND SKILLS (may be developed after employment)

Knowledge of: Child support statutes and regulations relating to the setting, modification and termination of child and medical support orders; domestic violence statutes and application to requests for protection; rules of civil procedure; rules of evidence; Ohio Rules of Professional Conduct; Judicial Canons; case law regarding property division, parental rights, child and spousal support, contempt, domestic violence; and interpretation of decrees, agreements and previous decisions. Applicable procedures and practices of the Court of Domestic Relations including familiarity with the Local Rules of Practice, the Court’s personnel policies, proper courtroom etiquette, and basic computer and office equipment skills.

Ability to: Conduct trials and hearings. Interpret statutes and case law relating to all domestic relations matters. Communicate with attorneys, the general public, other employees and Court officials in an effective and courteous manner; work under pressure and maintain composure in dealing with potentially irate and hostile litigants; accept constructive criticism and direction; must be professional at all times and work cooperatively with all other departments within the Court and persons from other courts, agencies and providers; maintain regular attendance, proper

Skill in: Legal Research and writing. Oral and written communication with staff, attorneys, and litigants. Time and case management. Communicating with staff and others, both orally and in written form, operating basic office machines, operations of Windows based computer system, and courteous telephone etiquette. Completing tasks timely and free from excessive and or recurring mistakes.

8:00 a.m. to 4:00 p.m., Monday through Friday

Starting Salary:

$82,000.0000 Yearly, non-exempt
